Oil industry sues over Biden truck emissions rule

A leading oil industry group is going to court again over the Biden administration’s climate rules for the transportation sector.

Biofuel producers, agriculture groups and truckers — led by the American Petroleum Institute — will file suit Tuesday in the U.S. Court of Appeals for the District of Columbia Circuit against EPA’s new emissions rules for heavy-duty trucks, saying the requirements exceed the agency’s authority.

The move comes a week after the trade group sued to block EPA’s tailpipe emissions rule for passenger cars and trucks. That lawsuit — the first time API has sued over the tailpipe rules — challenges the agency’s emissions cap for model years 2027 to 2032, which marks the strongest-ever tailpipe clampdown.

The challengers to the heavy duty truck rule for model years 2027 to 2032 include the American Farm Bureau Federation, the National Corn Growers Association and the Owner-Operator Independent Drivers Association.
